Introduction
These Terms of Service (the "Terms") govern your booking of travel services through Joy Life, Inc. ("Joy," "we," "us," or "our") via the Joy website located at http://withjoy.com and related booking tools (collectively "Joy Travel").
These Terms, together with your booking confirmation email (the "Booking Confirmation"), apply to all bookings of travel services (each, a "Booking") made through Joy.
By making a Booking, you agree to be bound by these Terms. If you do not agree, do not proceed with a Booking.
A copy of these Terms will be sent to you in your Booking Confirmation email. We also recommend that you save or print a copy for your records.
Important notices:
Section 6 (Pricing, Taxes, and Payment) explains how and when all fees — including any payment processing fee — are disclosed.
Section 10 (Disputes, Governing Law, and Arbitration) contains provisions that vary by your country of residence, including an arbitration agreement and class action waiver that applies to US consumers and may affect your legal rights.
Section 11 (Statutory Consumer Rights) explains rights that cannot be limited or excluded regardless of anything else in these Terms.
Definitions
"Travel Services" means travel services made available through Joy, including accommodations, car rentals, activities, and other travel-related products.
"Travel Provider" means the third-party supplier (e.g., hotel, rental car company, activity operator) that provides the Travel Services.
"Supplier Platform" means a third-party booking or distribution platform used by Joy to source Travel Services.
"You" means the individual making a Booking, including on behalf of other travelers.
"Merchant of Record" means Joy Life Inc., who is responsible for processing your payment and issuing any applicable refunds for a given Booking.
Role of Joy
Joy acts as an intermediary that enables you to search for, compare, and book Travel Services offered by Travel Providers. Joy does not own, operate, or control Travel Providers or the Travel Services they provide.
Certain Travel Services offered through Joy are supplied via our affiliated companies acting as a Supplier Platform. Where applicable, additional supplier platform terms may apply and will be made available during the booking process or upon request.
Where Joy acts as Merchant of Record, Joy accepts direct responsibility for payment processing and refund obligations for that Booking, as described in Section 6. The intermediary descriptions above do not limit Joy's direct obligations to you where Joy is the Merchant of Record.
For UK and EU consumers: Joy offers standalone lodging bookings only. Joy does not sell package holidays or linked travel arrangements as defined under the UK Package Travel and Linked Travel Arrangements Regulations 2018 or the EU Package Travel Directive (2015/2302), and those regulations do not apply to your booking.
Nothing in this section limits or affects your rights under the UK Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the EU Consumer Rights Directive (2011/83/EU), or any other mandatory consumer protection law applicable in your country of residence.
Joy does not guarantee availability, pricing, or suitability and does not endorse any Travel Provider.
Eligibility and Booking Conditions
By making a Booking, you represent that:
You are at least 18 years old and have legal capacity to contract.
You are booking for personal, non-commercial use.
All information you provide is accurate and complete.
If booking for others, you have authority to bind them and accept these Terms on their behalf.
You authorise Joy to charge the provided payment method for the full amount displayed at the time of booking, including taxes and fees.
You agree not to make fraudulent, speculative, or false Bookings.
Travel Provider Rules and Restrictions
Each Travel Service is subject to the applicable Travel Provider's rules, policies, and restrictions, including cancellation, refund, no-show, and change policies ("Rules and Restrictions").
These Rules and Restrictions are disclosed during the booking process and form part of your contract with the Travel Provider. Failure to comply may result in cancellation without refund.
Pricing, Taxes, and Payment
Pricing and Fee Disclosure
The total price you will pay — including all mandatory taxes, service fees, and any applicable payment processing fee — will be clearly displayed before you are asked to confirm payment.
Where a payment processing fee applies, it will be displayed as a separate line item in the booking flow before you confirm your Booking.
Prices are dynamic and may change until a Booking is confirmed. Obvious pricing errors may result in cancellation or price correction, in which case you will be notified and offered a full refund.
Cancellation fee estimates: Where cancellation fees are quoted during the booking process, those figures are the actual fees applicable under the Travel Provider's Rules and Restrictions at the time of display. If a fee range is shown, the applicable amount will be confirmed before any cancellation is processed.
Taxes and Fees
Displayed total prices include all mandatory charges. Travel Providers are generally responsible for remitting applicable taxes, unless otherwise required by law.
Payment Processing
Payment may be processed by:
Joy,
A Supplier Platform (including Expedia Group entities), or
The Travel Provider directly.
The entity processing your payment — the Merchant of Record — will be disclosed during checkout. Additional foreign transaction or currency conversion fees imposed by your bank are your responsibility.
Australian Consumers
Joy complies with the Australian Competition and Consumer Commission (ACCC) pricing requirements. All mandatory fees are included in the total price from the point of first display. Drip pricing — the practice of revealing mandatory fees late in the checkout process — is not used on Joy Travel.
Changes, Cancellations, and Refunds
All changes and cancellations are governed by the applicable Travel Provider's Rules and Restrictions, which are disclosed before you complete your Booking.
Joy may assist with change or cancellation requests but does not guarantee refunds beyond what is owed under the applicable Rules and Restrictions. Administrative fees may apply where permitted and disclosed in advance.
Refund Processing Timelines
Where a refund is owed, it will be processed by the Merchant of Record within the following timeframes:
UK and EU consumers: within 14 calendar days of the cancellation or refund determination, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the EU Consumer Rights Directive.
Quebec consumers: within 15 days of the cancellation, in accordance with the Quebec Consumer Protection Act.
All other consumers: within 10 business days of the cancellation or refund determination.
These timelines run from the date the refund is approved. Card network or bank processing times may affect when funds appear in your account and are outside Joy's control.
No Show
In the event that a guest fails to arrive or check in on the confirmed date of check-in, the reservation will be considered a "No Show." The guest will forfeit the reservation in its entirety, and no refund will be issued. This policy applies regardless of the reason for non-arrival unless otherwise covered directly with the property.
UK and EU Cooling-Off Rights
Under the UK Consumer Contracts Regulations 2013 and EU Consumer Rights Directive, consumers generally have a 14-day right to cancel distance contracts. However, accommodation and transport bookings with specific dates are exempt from this statutory cooling-off right. Your cancellation rights for dated hotel or travel bookings are therefore governed by the Travel Provider's Rules and Restrictions, not the statutory 14-day withdrawal right.
Quebec Consumers
If you are resident in Quebec and Joy has failed to provide all information required under the Quebec Consumer Protection Act before purchase, you may have a right to cancel within 7 days of receiving the required contract information. Quebec consumers may also exercise chargeback rights within 60 days if Joy fails to process a required refund.
Travel-Specific Terms
Accommodations
"Pay Now" and "Pay Later" options may be available and will be clearly labelled.
Properties may require a deposit or credit card hold at check-in.
No-show policies apply and may result in forfeiture of the full stay amount.
Car Rentals
A valid credit card and driver's licence are required at pickup.
Additional charges (insurance, fuel, extras) may apply locally and are outside Joy's control.
Activities and Things To Do
Activities may be non-refundable and non-transferable; this will be stated before booking.
Liability waivers may be required by operators.
Liability and Disclaimer
To the maximum extent permitted by applicable law:
Joy is not liable for the acts, errors, omissions, or negligence of Travel Providers.
Joy is not responsible for personal injury, death, property damage, or other losses arising from Travel Services provided by Travel Providers.
Joy's total liability to you in connection with a Booking will not exceed the amount paid to Joy for that Booking.
These limitations do not apply where prohibited by law. In particular:
They do not apply to liability for Joy's own fraud or fraudulent misrepresentation.
They do not exclude or limit any rights you have under the Australian Consumer Law, the UK Consumer Rights Act 2015, the EU Consumer Rights Directive, the New Zealand Consumer Guarantees Act 1993, or any other applicable mandatory consumer protection law.
They do not exclude liability where doing so would be unlawful under the laws of your country of residence.
Where Joy is liable for failure to comply with a consumer guarantee or implied term that cannot be excluded by law, Joy's liability is limited, to the extent permitted by law, to resupply of the relevant services or payment of the cost of resupply.
Indemnification
You agree to indemnify and hold harmless Joy and its affiliates from any claims, losses, or expenses arising out of:
Your breach of these Terms,
Your violation of law or third-party rights, or
Your use of the Joy Travel Site or Travel Services.
This indemnification obligation does not apply to the extent prohibited by the laws of your country of residence.
Joy is not responsible for interruptions caused by events outside the reasonable control of Joy or the Travel Provider, including natural disasters, severe weather, government actions, labor disputes, public health emergencies, transportation disruptions, acts of terrorism, civil unrest, or other force majeure events.
Privacy
Personal information is processed in accordance with Joy's Privacy Policy, available at http://withjoy.com/privacy. Payment data may also be processed by Supplier Platforms or Travel Providers under their respective privacy policies.
Disputes, Governing Law, and Arbitration
This section varies by your country of residence. Please read the subsection that applies to you.
If you initiate a payment dispute or chargeback after receiving travel services, Joy reserves the right to recover unpaid amounts and associated costs where permitted by law.
Informal Resolution — All Users
Before initiating any formal proceedings, you agree to contact Joy at travelsupport@withjoy.com and allow 30 days for Joy to attempt to resolve the dispute informally.
Consumers in the United States
These Terms and any dispute arising hereunder are governed by the laws of the State of Washington, excluding its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or your Booking that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except where eligible for small claims court.
Class actions and representative proceedings are waived to the extent permitted by applicable law. You and Joy each agree to bring claims only in your individual capacity.
Consumers in the United Kingdom
These Terms are governed by the laws of England and Wales (or, if you are resident in Scotland or Northern Ireland, the laws of Scotland or Northern Ireland respectively).
Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015, and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Consumers in the European Union
Your mandatory consumer protection rights under the laws of your country of habitual residence within the EU apply to your Booking. Under the Rome I Regulation (EC 593/2008), the choice of Washington state law in Section 10.1 does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of your country of residence.
Consumers in Canada
These Terms are governed by the laws of the Province of British Columbia for consumers outside Quebec, except where mandatory provincial consumer protection laws of your province of residence apply.
Arbitration is generally enforceable in Canada on an individual basis, subject to the following Quebec exception.
Quebec residents: The Quebec Consumer Protection Act (RLRQ c P-40.1) applies to your Booking. To the extent any provision of these Terms conflicts with your rights under that Act, the Act prevails. Quebec law may limit the enforceability of arbitration clauses in consumer contracts; to the extent the arbitration clause in Section 10.1 conflicts with your rights under Quebec law, it does not apply to you.
Consumers in Australia
The arbitration clause does not apply to Australian consumers to the extent they would restrict or remove any right or remedy you have under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010).
Your rights under the ACL — including consumer guarantees — cannot be excluded, restricted, or modified by contract. Any term of these Terms that purports to do so is void to that extent.
These Terms are governed by the laws of the jurisdiction in Australia in which you are resident. You may bring claims before the courts of that jurisdiction.
Consumers in New Zealand
Nothing in these Terms excludes, restricts, or modifies any rights you have under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ), which cannot be contracted out of in consumer transactions.
The arbitration clause and Washington state governing law in Section 10.1 do not apply to New Zealand consumers to the extent they would limit or remove any remedy available to you under those Acts.
These Terms are governed by the laws of New Zealand for New Zealand consumers. You may bring claims before the courts of New Zealand.
Statutory Consumer Rights
Nothing in these Terms limits or excludes any right or remedy that cannot be limited or excluded by law. Depending on your country of residence, you may have rights that Joy cannot take away, including but not limited to:
United States: State consumer protection rights (including California, New York, Washington, Florida, and other states).
United Kingdom: Rights under the Consumer Rights Act 2015, and Consumer Contracts Regulations 2013.
European Union: Rights under the EU Consumer Rights Directive, and mandatory laws of your member state.
Canada: Rights under the Quebec Consumer Protection Act, Ontario Consumer Protection Act, and applicable provincial consumer protection legislation.
Australia: Rights under the Australian Consumer Law that cannot be excluded, restricted, or modified.
New Zealand: Rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
If you are unsure of your rights, we encourage you to contact your national or local consumer protection authority.
General
These Terms constitute the entire agreement between you and Joy regarding Travel Services, subject to the mandatory consumer laws of your country of residence.
Joy may update these Terms at any time by posting revised Terms. Continued use of Joy Travel after the effective date of revised Terms constitutes acceptance of the revised Terms.
If any provision is held unenforceable in a particular jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full effect.
The UN Convention on Contracts for the International Sale of Goods does not apply to these Terms.
